Terms and conditions

Sine Wave · Johannes Jacobi · Arnstadt Germany

Who you are contracting with

Awake is provided by Sine Wave (trading name of the sole proprietor Johannes Jacobi), Bielfeldstraße 2, 99310 Arnstadt, Germany. Contact: awake@sine-wave.studio. By using Awake you enter into an agreement with Sine Wave on these terms.

Acceptance

By downloading, activating or continuing to use Awake you agree to these terms. If you buy on behalf of a company you confirm that you may bind that company. Otherwise you confirm that you are of legal age where you live.

What Awake is

Awake is a paid productivity app for macOS. It is a normal desktop application, downloaded as a signed and notarised app, that manages display and sleep settings for you while a long running task is in progress and hands control back to macOS when the task ends. It uses the power management interfaces Apple publishes for exactly this purpose. It installs no kernel extension, modifies no system file, removes no protection and unlocks no paid feature of any other product. A licence key covers up to three Macs and includes updates. There is no subscription. The trial needs no card, just your email.

Licence

You receive a limited non exclusive and non transferable right to use Awake on up to three Macs you control. You may move a seat yourself at any time. You may not resell or redistribute Awake, share your key publicly, reverse engineer the app or circumvent the seat limit or the licence check.

Acceptable use

You must not use Awake for anything unlawful, for fraud or spam, to infringe the rights of others, or to interfere with the security of our systems. That includes malware, probing, scraping and any attempt to gain access you were not granted.

Intellectual property

Sine Wave retains all rights in Awake including the software, its documentation and its branding. Nothing in these terms transfers ownership to you.

Service level and warranties

Awake is provided as it is. We do not promise uninterrupted or error free operation and we cannot guarantee that macOS will always behave as it does today. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose. Statutory rights of consumers remain untouched.

Liability

Our aggregate liability is limited to the amount you paid for your licence in the twelve months before the claim. We are not liable for indirect or consequential damage such as lost profits, lost data or loss of goodwill. Liability for intent, gross negligence, injury to life or health and any liability that cannot be limited by law is unaffected.

Payments and orders

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms. See also our refund and withdrawal page.

Suspension and termination

We may suspend or end access to a licence in case of material breach of these terms, non payment or a chargeback, a security or fraud risk, or repeated and serious misuse. Where access ends, locally stored data on your Mac stays with you — Awake keeps its records in your home folder.

Changes

We may update these terms for legal or product reasons. The current version always lives on this page. Material changes will be announced by email to buyers.

Governing law

German law applies. Where you are a consumer, the mandatory consumer protection rules of your country of residence remain in place. Place of jurisdiction is Arnstadt Germany as far as the law allows.
